85 Year Old in Hospital Misses Last $484 House Payment is Charged $5800

An elderly New Jersey woman billed $5,800 after missing the final payment on her 30-year mortgage can pursue her lawsuit against the debt collectors.

Lawyers for 85-year-old Dorothy Rhue Allen say the fees charged by two banks and a law firm violate consumer-protection laws.

The suit says LaSalle Bank and Cenlar Federal Savings Bank started foreclosure proceedings in 2007 after the hospitalized Allen missed the last $432 payment on her Deptford, N.J., home.

The banks advised her lawyers she could pay $5,800 to avoid foreclosure. But her lawyers instead sued over the fees, and the foreclosure action was dropped.

But I don't consider her as such anymore. My grandparents have had health problems over the past year, so they recently moved in to assisted living. The woman in question wasted little time in trying to take advantage of the situation, and attempted to get a bit grabby with their house. She cut ties with the rest of us in our family once we stood up to her.

It just struck me that the bank is very similar to the person I mentioned above in taking advantage of an elderly person like that.

Damn, these banks are vultures - they don't care who they screw sometimes. They cover their own tookuses, and go after Joe or Jane Average for something beyond that person's control. It's just not right. I hope she wins big...she has a fantastic case against them.

14. I once had a seven year balloon practice loan

and the late payment fee was 1732.00 a month. No reprieve, no questions asked or answered. I used to Certify return receipt requested my payments and no fewer than three or four times, I had to call up, nearly screaming at them after a while, to get the charge reversed b/c I had in my hand, evidence that they received the payment before the due date. It was outrageous...
