POMONA - Family members of a 26-year-old Pomona resident who died in an Oct. 16 officer-involved shooting have filed a claim against the city seeking damages.
Attorney Luis Carrillo, who represents the family of Andres Avila, made the announcement Tuesday outside Pomona City Hall.
The claim is a step leading up to the filing of a lawsuit.
Carrillo, who filed the claim on behalf of Avila's parents, Jesus and and Maria Elena Avila, and Avila's estate, and is calling for unlimited damages.
In the claim Carrillo alleges police have made false statements about Avila; violated his Fourth Amendment right to be free from excessive force; in addition to the claiming he was subject to false arrest, false imprisonment, battery, negligence, state civil rights violations, wrongful death and others.
Earlier this year Avila filed a personnel complaint related to a July 4 incident in which he was beaten by three Pomona police officers at a family gathering, Carrillo said.
He said guests at the gathering used cell phones to record the incident (view one of the videos here) which included Avila being shocked with a stun gun.
