Court could set precedence for how cities and counties in California regulate medical marijuana
I pray this is done right..
I did finally see here someone fighting for the Patients right to access and left to grow their own..
Which always was the spirit of California Law...

Arguments wrap Upland medical marijuana case; decision expected in 90 days

A ruling by the court could set precedence for how cities and counties throughout California regulate medical marijuana dispensaries.

"The court asked very good questions," G3 attorney Roger Jon Diamond said. "The judges are smart and conscientious. I'm optimistic. The argument went very well."

Upland attorney Mitchell Abbott declined comment.

The president of G3 Holistics is Aaron Sandusky.

On Tuesday, the Drug Enforcement Administration, aided by San Bernardino County sheriff's deputies and police, raided the Upland location and five others associated with Sandusky, which they believe are illegally selling marijuana to the general public.

1. Meh. If the court says "no" to MMJ, they have their justification to raid,
If the court says the MMJ providers are operating legally, the feds will just ignore it and keep doing what they want to do.

2. Yes, what's to keep an enlightened court from being effectively overruled by Obama's DoJ?

3. Is this a Federal court? If not it really doesn't matter what they say.
The Feds are bound and determined to put an end to medical pot.

6. it seems to me the Obama administration is closely following state law
by claiming to not go after patients and their non-profit caregivers - he is following the CA law.

if CA legalizes, I wonder if his admin would back off? I mean, logistically, other than some symbolic action, if cannabis were made legal there is no way the DEA, etc. could go after all the different ways people will expand their businesses into this market. There just aren't enough DEA agents, money in the budget - unless they want to spend money stupidly.

5. What's next for G3 medical marijuana dispensaries in Upland,Colton and Moreno Valley?
Edited on Sat Nov-05-11 01:06 AM by DreamSmoker
Aaron Sandusky has had a rough week.

Sandusky, 41, has been trying to keep his medical marijuana dispensaries open in Upland, Moreno Valley and Colton.

On Tuesday, raids were conducted on the three dispensaries as well as his Rancho Cucamonga home and the Rialto home of his partner John Nuckolls.

On Wednesday, Sandusky, the president of G3 Holistic Inc., was involved in a 4th District Court of Appeal case in Riverside that could determine if Upland can legally ban his marijuana dispensary and ultimately set a precedent in the state for how cities and counties regulate marijuana dispensaries.
