Waterboarding is illegal. We have tried other nations for it, and we have even tried domestic Sheriff's departments for it.

This nation selectively uses the law whenever possible.

Anyone who claims that it's not torture has never been waterboarded. I had it done to me (on a dare) and it is no joke. I lasted 5 seconds...I thought they were drowning me.
