I really don't think so. Immediate intervention. Physical exam of child should be sufficient to prove crime. Irrespective - protection proceeds proof.
You don't go call daddy instead of the police, and I mean real police not rent a cops.
Now that the grad assistant is claiming he told police, I think strongly that something in the written record would be essential for any witness.
It is going to get hard to tell the lies from the truth from the grad assistant. I think his value as a prosecution witness is nill.

Unless my supervisor isn't available, in which calling the police comes second.
I'd probably also report the incident directly to the HR director.

The molester would need a coroner.
I was molested as a kid, and while it didn't have the permanent psychological impact on me that it has on some, all bets would be off if I actually caught someone in the act of doing it to another child.
