I think what he meant to say was, "I am not about to set any precedents that I might regret when I am the outgoing President."
It was not only that Obama did not prosecute Dummya, he honored him.
Sending him and Bubba to Haiti was one such honor. Making him the first call after Osama started to swim with the fishes was another honor.
And who could forget this great photo of Obama putting the Medal of Freedom around Poppy's neck:

And then there are white house meetings whenever Poppy is in D.C. that don't even appear on Obama's schedule or get any publicity at all.
When asked what the men discussed and why it wasn't on the schedule, the White House released a statement saying, “The three men enjoyed a personal visit in the Oval Office – as they have done on previous occasions when President Bush is Washington.”
