I have no idea what Florida election law calls for, in terms of replacing a sitting Congressman, whether they are appointed by Governor for the remainder of the term or a special election is called.

Governors do not appoint Representatives. Ever.


They do, however, sometimes schedule the Special Election to elect a new House Rep.

According to the US Constitution and state law, the governor of the state calls for a special election to replace the vacant House seat. The full election-cycle must be followed including political party nominating processes, primary elections and a general election, all held in the congressional district involved. The entire process often takes as long as from three to six months.

While a House seat is vacant, the office of the former representative remains open, its staff operating under the supervision of the Clerk of the House of Representatives. The people of the affected congressional district do not have voting representation in the House during the vacancy period. They can, however, continue to contact former representative's interim office for assistance with a limited range of services as listed below by the Clerk of the House.

It is unlikely that he could ever win it again, as currently mapped. The good news is redistricting, when it occurs under the new Fl constitutional ammendment will likely balance the seat more to the dems favor. This will be bad news for Corrine Brown, which is why she has filed suit to try to stop it. The punchline however is that her district includes all the traditionally African American communities from Orlando to nearly Jacksonville. When it is remapped, there will be alot more Dems in the new districts. We outnumber the Repugs here, but the district maps concentrate Dems heavily in a small number of districts, so our representation is disproportionately republican. If you balance partisan registration more evenly in the new districts, then the Dems will have the registration advantage in a great number of them. This is why the republican party has joined Corrine in the suit.

With a new district map, Alan has a chance, although I expect there will be others in the primary if this is the case.

He can live anywhere is the state he wishes, but the district would be unfamiliar territory for him.

16. I Highly Doubt It

You do realize that district 25 is in South Florida, whereas 8 is in Central Florida. Rivera's district is a long way politically and geographically from Grayson's (former) district). I believe one of the things that appealed to Congressman Grayson about Central Florida was the theme parks.

District 8 is +2 Republican, District 25 is +5 Republican. District 8 is less than 18% Hispanic, and District 25 is over 62% Hispanic. Not to say that Hispanics couldn't vote for a white guy, but remember that in south Florida, Hispanics are more likely to be Cuban (conservative) whereas in Central Florida, Hispanics are more likely to be Puerto Rican (moderate or liberal).

District 25 would be a bad fit for him. I'm not even sure returning to Congress is best for him or the country. There may be better ways he can serve the liberal cause and the USA...
