The family of one dead servicemember did sue, won the initial lawsuit, it got appealed, the appeals court overturned, and worst, ordered the family to pay WBC's legal fees, which were paid by Bill O'Reilly (who'd have thunk it - the WBC's so fucking vile they're uniting liberals and conservatives - that's no mean feat!) and it's gonna get appealed again and ruled upon by the Supreme Court.

Personally, I think the best way to legally attack the WBC is to assert that their signs and slogans amount to Fighting Words, as defined in case law, create some local laws prohibiting speech designed to incite violence, engineered around Fighting Words case law, and prosecute 'em!
