Canadian court dismisses appeal to extradite terror suspect to US on terrorism charges
By Associated Press, Updated: Friday, May 6, 4:32 PM

TORONTO A Canadian court has dismissed an appeal by the federal government to extradite a Canadian man indicted in the U.S. on charges he supplied al-Qaida with weapons.

Abdullah Khadr, 29, was held in Canada on a U.S. warrant after his December 2005 arrest. He is wanted in the U.S. for allegedly purchasing weapons for al-Qaida and plotting to kill Americans abroad.

The Ontario Court of Appeal dismissed an appeal Friday filed by the Attorney General of Canada on behalf of the United States.

The federal government had argued last month that the original judge in the case went beyond his jurisdiction in refusing to extradite him to the United States. Khadr was freed last summer after that decision.
