South Carolina: Right-to-Carry Reform Bill Introduced in Columbia!
Friday, January 14, 2011


The 119th South Carolina General Assembly began its session this week, and on Wednesday, Jan. 12, State Representative Mike Pitts (R-14) introduced H. 3292, a comprehensive Right-to-Carry reform bill.

Joining Rep. Pitts as cosponsors are Representatives Dan Cooper (R-10) and Greg Delleney, Jr. (R-43). H. 3292 seeks to reform current law to remove certain restrictions on where one may lawfully carry a concealed firearm, establish that property owners may not set policies or rules that would prohibit the transportation or storage of legally-possessed firearms or ammunition if it is locked, out of sight, within a privately-owned motor vehicle, and create a straight recognition standard for valid permits issued by other states.

We will be giving a more detailed analysis of this legislation, as well as report on other firearm-related bills, in the near future. In the meantime, please take a moment to call your State Representative and urge him or her to cosponsor H. 3292. Their contact information can be found here.

1. Is there a REASON that it isn't enough for them to be able to carry guns
where they can carry them NOW?

You'd think they'd have a little more shame than to introduce this the week after the Tucson Massacre.

I'm STILL snowed in (I'm in Georgia). It's only 220 feet long, 25 degree grade and loose gravel under 6 inches (still) of snow. I'd put you on my Christmas card list, I promise.

11. Actually, I'd love to.
Every time I go up to Mt. Lemmon to ski, I bring back a truck-bed-load of snow for my girlfriends daughter to play with.

My Grandmother just called, and said I need to get up to N.H. to help her shovel. Her rural driveway is much like yours, only about 1/4 mile long. Fortunately, she has a bulldozer and a very nice small tractor with plow attachment...

So many invitations, so little time.... How to chose...

10.  When facts are inconvenient (or nonexistent), start waving the bloody shirt.
I do notice a disturbing resemblance to the rhetoric that eminated from the Cheney White House after 9/11, when the PNAC

types were pushing their 'reforms'.


I'm sure that for the forseeable future, one or more of the gun Prohibitionists will make reference to the Tuscon massacre

in most discussions of changes to gun laws in a way that strongly implies that the mere mention of it "proves" their point.

13. Here's one reason: South Carolina is not Beirut in the early 80's.
The place isn't dangerous enough to justify it.

And they've ALREADY made their point about getting to carry guns pretty much anywhere they want to.

I'm not antigun, but this is just obsessive and pointless. Nobody is persecuting gun owners.

Nobody wants to send gun owners to concentration camps, for God's sake.

And gun control is a dead issue at the federal level and will be for years to come.

The whole "we HAVE to carry guns everywhere or they'll take 'em away from us" thing is bogus. Nobody is THAT obsessively antigun. This is just pandering to paranoia for the sake of pandering to paranoia.

My whole point was that there's no pressing concern that actually justifies any MORE legislation announcing that people can carry guns in even MORE places and at MORE times. There's no chance of any federal gun control legislation even being introduced, let alone passing, in this Congress or any in the forseeable future.

The gun people simply don't NEED to be this aggressive. They've won.

Would it be O.K. with you if caucasians were not allowed to have free speech on only the east-west streets of a town?

Would it be O.K. if women could be strip-searched without warrants at public libraries?

Civil Rights apply in every public forum. Or am I being "aggresive"?

Sorry, dudes...but it's the people who DON'T own guns that are in danger in the post-Tucson situation...not the ones who are.

This whole "we have to carry them EVERYWHERE" thing got officially ridiculous when they insisted on taking them into Starbucks.

And besides, guns can't be used for a progressive revolt in this country. They can only be used to give the Right power.

In case you didn't notice, they didn't even have the votes for major gun control legislation after BOBBY KENNEDY was shot.

You've already secured the permanent uncompromised survival of the Second Amendment. "The Right To Carry 'Em EVERYWHERE" bills are totally unnecessary.

Starbucks abides by the gun laws that govern their locations. If carry is legal, you can carry in one. If carry is illegal, you can't.

It's a Starbucks policy, no one pushed for it.

if the county ive lived in all my life decides im no longer welcome at the park for my morning jog if im armed. Its not just at the federal or state level this issue is dealt with. In my state local towns pass laws frequently that ban guns here or there, even though passing those laws are against the law. Or another issue we've had to fight is the state mandates that a carry permit costs $21, but some sheriffs charge $25, or $35, or $50. One might say thats not much when some states cost $200 and have many more loops to jump through than we do, but its still public officials breaking the law, and sometimes refusing to follow the law. If thats not an infringement, then I cant say what is. So its not just the big picture like McCarthys law, or the Brady Campaigns newest idea. Its all the little things that can add up to a whole lot.

25. To clarify
this bill and others like it in many other states are designed for one purpose. It is only to round out existing laws. It was somewhat unforeseen when concealed carry legislation passed originally that employers and other businesses would attempt to regulate the possessions of people in their own cars. This doesn't change the rules about carrying guns into a business or job site. It simply allows for people with concealed carry permits not to be fired or otherwise in violation of the law for leaving their gun in their car. That is all this does.

27. Your car should be off limits to your employer
just as your employer shouldn't be allowed to prohibit reading material in your car, or your home for that matter. If you have a carry permit, you employer shouldn't be allowed to prohibit you from using that permit before or after work. It has no effect on the actual job site. For instance, our state's largest employer is Boeing. Boeing had a policy that employees could be fired for leaving their legally possessed firearm in their vehicle while at work. My state passed a similar law which tells Boeing that they have no ability to control what legally possessed items are in an employee's car. At the same time, in the same legislation Boeing and other employers were given protection from liability claims if an employee used their gun unlawfully on the employer's property.
