"I will not comment on an ongoing investigation."

Why does Rove still have clearance when EVERYONE knows about the testimony against him, yet Sheehan will be arrested for threatening national security based on nothing more than "Well, we have to find SOMETHING to arrest her for." Shouldn't there be a 3-year grand jury before she's arrested?
