The Boston Globe has an article on 6 Senators who will be introducing legislation on how military detainees should be treated. The six Senators are McCain, Graham, Leiberman, Chambliss, Ayotte and Brown. The first 4 all voted for the Military Commission Act - and all but Leiberman voted against Kennedy's amendment that explicitly forbade the use of 10 punishments including waterboarding.
Here is Brown's comment:
“Terrorists should be detained at Guantanamo Bay, and tried according to the laws of military justice,” Brown said in a statement. “Terrorists should not be allowed to enjoy the rights and privileges protected by the U.S. Constitution. These are not common street criminals, they are terrorists who have one stated purpose: to kill Americans and our allies.”

It may be that Lindsey Graham and John McCain were protecting Bush and really didn't want what was in the MCA. In addition Chambliss and Ayotte are pretty RW.
