PHOENIX — Employees cannot use federal civil-rights laws to sue the owners of Arizona charter schools, the 9th U.S. Circuit Court of Appeals ruled Monday.

The judges acknowledged that under Arizona law, charter schools are "public schools." They are authorized to operate under state law and must comply with some, but not all, of the same requirements that cover conventional district schools.

But Judge Sandra Ikuta, writing for the unanimous court, said that does not make the school and its owners "state actors," something required to make a civil-rights challenge. Instead, the court concluded, the school is a private company, at least for purposes of deciding whom to hire, fire and, in this case, whether to provide a referral for a future job.

The particulars of the specific case attached to this ruling are problematic, but I certainly hope the ACLU is all over this one. . . .especially since Tucson is ahead of the curve in the implementation of Charter programs.

3. Why Arizona is the bottom state in education

That is one of many many problems concerning education here in Arizona. I moved here from Mississippi and was shocked at the education system in Arizona, and often found myself laughing at how inferior Arizona is to Mississippi in education. For someone from Mississippi to laugh at your education system is something to be very ashamed of, but the people here don't seem to be bothered.

I live in Phoenix and I think the problem is we have a lot of transplants from the Midwest and inland CA here who like their low property taxes and don't give a shit about the schools because they don't have kids in them. They've got their McMansions and their golf and their strip malls and Shurf Joe is keeping them "safe".
